WANTGLASSES.CO.UK TERMS AND CONDITIONS

Please make yourself familiar with the following terms and conditions, which cover all orders from Wantglasses.co.uk. Please note they do not affect your statutory rights.

1 About these conditions

‘Wantglasses.co.uk’ means J.M.S Vision Ltd (Company No. 6477378), based at Unit 3,Bredbury Business Park, Stockport, Cheshire SK6 2SN and trading under the name www.wantglasses.co.uk.

‘Order’ refers to orders placed as set out in section 2 below.

‘Goods’ means any items that you want to purchase through an order that we make available for sale. ‘Site’ refers to the website operated and owned by Wantglasses.co.uk.

2 Goods orders

2.1 Customers must place orders through the site ordering system, by telephoning Wantglasses.co.uk on 0845 259 1151 or by posting a mail-order form, which can be downloaded from the site, to WantGlasses, Unit 3,Bredbury Business Park, Stockport, Cheshire SK6 2SN , or faxing it to 0808 280 0317.

2.2 Submitting an order constitutes an offer to purchase Goods from Wantglasses.co.uk. Any confirmation of receipt of the Order by Wantglasses.co.uk, whether verbally or by e-mail, will not represent an acceptance of your Order.

2.3 If you contact wantglasses.co.uk by e-mail, fax or post, you can change your Order at any time until we dispatch your Goods. Please alert us to changes immediately, owing to our rapid order turnaround.

2.4 No binding contract exists between you and Wantglasses.co.uk until we have dispatched your Goods.

3 Your obligations

3.1 By placing an Order, you attest that you are aged at least 16, not registered blind or partially sighted and are ordering only for yourself. You also attest that you have a written prescription given to you by a registered medical practitioner or registered optometrist. If you are under 70 years of age, you must also have had a sight test carried out by a registered professional in the last twenty-four months. If you are 70 or over, this must be within the last twelve months.

3.2 To place an Order, you must give Wantglasses.co.uk full details of your prescription, including notes, a copy of your original prescription if asked, and the contact details of your optician.

3.3 If you send Wantglasses.co.uk your spectacles for copying, they must be made to the written prescription set out in 3.2 above.

3.4 Placing an Order also validates that you do not know any reason why the Goods might be unsuitable for you.

3.5 You must provide Wantglasses.co.uk with proof, if asked in a reasonable manner, that you are eligible to buy the Goods.

3.6 You must provide Wantglasses.co.uk with details of any problems you have experienced when wearing glasses in the past.

3.7 When you place an Order, you accept that you are an individual consumer. The Goods are solely for your own personal use and are not for resale in whole or in part.

3.8 You must be a resident of the United Kingdom and the authorised holder of any credit/debit cards you use to purchase Goods.

4 Pricing

4.1 The price you pay for your Goods is the price stated on the Site or in the mail-order catalogue when you place your Order.

4.2 Wantglasses.co.uk makes every effort to make sure our prices and other information online and in our catalogue are accurate. However, we are unable to guarantee that items are priced correctly. In the event of mispriced or changed-price Goods, we will contact you so that you can pay the correct price or cancel the Order.

4.3 Prices, inclusive of VAT, are in pounds sterling.

4.4 You can find the postage and packaging charges for every item on our Site and in our catalogue.

5 Delivery

5.1 Delivery shall be deemed to have taken place when the Goods arrive at the UK delivery address you stipulated on your Order.

5.2 Once we accept your Order, delivery will be made at latest 28 days after receiving your Order or at latest 28 days after a face-to-face consultation with a Wantglasses.co.uk optician, if this is necessary.

6 Inspection

6.1 Inspect your Goods carefully. It is your responsibility to contact us if anything is missing, or if they appear not to match the description or seem damaged or defective. If so, do not use them. You must also notify us if you have difficulty using the Goods.

6.2 It is your responsibility to check the written information about the Goods and to contact us if the two do not match.

6.3 Should your Goods prove defective when delivered, at our discretion we will repair or replace them or offer a refund provided you return them in the same condition as you received them and with the packaging intact.

6.4 If Goods appear faulty, Wantglasses.co.uk will pay the costs of returning them to us, including postage, packing and delivery. Note, though, that you are responsible for these costs until they are received by Wantglasses.co.uk.

7 Fulfilment

7.1 Wantglasses.co.uk will make every effort to fulfil Orders. The availability of Goods can sometimes be out of our hands, though. If Goods are unavailable, Wantglasses.co.uk will offer you alternatives or your money back. Should you not respond, we might provide replacement Goods of similar quality or refund your money.

7.2 Wantglasses.co.uk makes every effort to make sure your Goods match the Site or catalogue descriptions. However, small variations can occur to parts, owing to manufacturers’ changes.

7.3 On the advice of our opticians, we have absolute discretion on accepting Orders. They might need to contact you, provide advice or arrange a face-to-face consultation before accepting your Order. They might also need to verify or discuss your prescription with your registered professional.

7.4 Wantglasses.co.uk's opticians might ask you for a new prescription - for example, if your retest date has elapsed.

7.5 Wantglasses.co.uk's opticians might, as a condition of accepting your Order, request a copy of your original prescription or ask you to contact the registered professional who gave you your prescription for verification or to discuss particular details.

7.6 Wantglasses.co.uk's opticians might also ask that you secure your pupillary distance measurement from your optician or that you obtain it in a free face-to-face consultation with us.

7.7 Please note that face-to-face consultations are not yet available in Northern Ireland and we cannot accept Orders from Northern Ireland residents if our opticians feel you need a face-to-face consultation.

7.8 If you do not send us your pupillary distance, Wantglasses.co.uk will use an average pupillary distance set by our supervising opticians. At their discretion, our optician may ask you to have your pupillary distance measured.

7.9 Wantglasses.co.uk reserves the right to refuse your Order if the delivery address is outside the United Kingdom, if it is for single-vision spectacle lenses with a spherical value of more than +/-8 dioptres or a cylindrical value of more than +/-4 dioptres. We may refuse your Order, too, if it is for bifocal or varifocal lenses with a distance spherical value of over +/-8 dioptres, a cylindrical value of more than +/-4 dioptres, or if the power addition between the distance and near elements is under +0.75 or over +3.50 dioptres.

8 Transfer of risk

8.1 When the Goods arrive at the delivery address in your Order and we have received payment, both title and risk in the Goods will pass to you.

8.2 If you cancel your Order, risk remains with you until it is received by Wantglasses.co.uk in return.

9 Refund guarantee

9.1 After you have cancelled your order in writing and returned the Goods to us, complete with all included items and packaging, Wantglasses.co.uk shall, provided the Goods are in as-new condition, reimburse you within 30 days of the earlier date of you notifying us of cancellation or the date we receive the Goods. This refund encompasses the total price you paid but not postage and packing or other costs of returning the Goods to us. You will be reimbursed by the same method you used to pay for your Goods.

9.2 To claim your refund, your Goods must be in as-new condition; we must receive payment in full and you must have met all your obligations under these Terms and Conditions.

9.3 You are obliged to tell us immediately by e-mail, fax or post about any manufacturing defects you notice within 3 days of delivery. At our absolute discretion, we will repair or replace the Goods or refund your money. Note that we are unable to do this if we have not received the defective Goods from you or if the problem is due to misuse.

9.4 In the case of a manufacturing defect, Wantglasses.co.uk will pay the return postage, packing and delivery of your Goods for repair or replacement. Reasonable costs of returning the defective Goods will also be paid for, subject to the request being made in writing.

9.5 Prescription Lens Return and Exchange Policy
All prescription lenses are considered special orders, and are therefore non-refundable.  Wantglasses.co.uk will however refund the full cost of the frames alone, provided they are in as-new condition.  We understand there may be times you want to change the frame even though the prescription lenses are perfect. If, within 14 days of receipt of product, you wish to exchange a frame that we have made prescription lenses for, you will be charged or credited the difference of the new frame cost. A lens credit of 50% of the original lens cost will be applied to the cost of any new lenses ordered.  In addition, new shipping charges will incur.

9.6 Prescription Guarantee
We guarantee 100% accuracy on all prescriptions or they will be remade at no charge. All prescription glasses, prior to leaving WantGlasses.co.uk, pass a quality control hand inspection. All prescription lenses that leave WantGlasses.co.uk are checked by a fully qualified member of staff who will assure they are made to your prescription.

9.7 Frame Choice
To save you time and money please ensure you have tried on the frame or sunglasses and you can confirm they are exactly what you want. We do not offer a ‘try at home’ service for designer frames or designer sunglasses.

10. Liability

10.1 This Agreement does not exclude or limit liability for fraud, death, personal injury or other liability caused by one party's negligence.

10.2 Wantglasses.co.uk will not be liable to you for any losses, such as contracts, insurance cover, income, goodwill or profits.

10.3 Wantglasses.co.uk shall not be liable to you for losses however caused in relation to this Agreement, even if advised of the possibility of loss or damage.

10.4 Wantglasses.co.uk can accept no liability for non-standard use of the Goods or if loss or damage results from inaccurate, false or misleading information provided by you.

10.5 Our total liability to you with regard to legal claims connected with an Order will not exceed the total sums received by us for the Order.

11 General matters

11.1 The headings in these Terms and Conditions are purely for convenience and do not affect the interpretation of this Agreement.

11.2 ‘Including’ means without limitation.

11.3 The Contracts (Rights of Third Parties) Act 1999 and any laws that supersede or amend it shall not apply to these Terms and Conditions and third parties have no right to enforce any contract.

11.4 Your obligations and rights under this Agreement are not sub-contractible or transferable in whole or in part.

11.5 These Terms and Conditions and your Order are the entire agreement between us and supersede all other agreements, promises or statements about the Order, including on the Site and in our catalogue and sales literature. Neither party has a remedy if a term is not set out in these Terms and Conditions or in your Order, except in the case of fraudulent misrepresentation by the other party. Our representatives, staff or agents will not vary or waive these Terms and Conditions; any such changes will not be effective unless expressly agreed to by us in writing.

11.6 Either party’s failure to assert its rights if these Terms and Conditions are breached does not mean those rights are waived.

11.7 Should any of these Terms and Conditions or Order be unenforceable, the others will remain in force subject to modifications that may be required to achieve their objectives.

11.8 English law and any relevant Order govern these Terms and Conditions. Both parties hereby agree that any disputes will be subject to jurisdiction of the English courts.

12 Force Majeure

Wantglasses.co.uk will not be liable for failing to fulfil its obligations under these Terms and Conditions because of any extraordinary event or circumstance beyond the control of each party, such as war, riot, natural disaster or strike action.

13 Notices

Any notices to Wantglasses.co.uk must be in writing, by prepaid post, to WantGlasses.co.uk, Unit 3,Bredbury Business Park, Stockport, Cheshire SK6 2SN or by fax to 0808 280 0317. Notices to you must be by prepaid post, fax or e-mail to the address in your Order. Posted notices will be deemed received two working days after posting. If e-mailed or faxed, they will be deemed received in the absence of a failure notice.
 
14 Grab-a-Grand
